Terms of Use

Last updated

These terms are an agreement between you and Crew VPN (“we”, “us”) for the Crew VPN apps (Android, iPhone and iPad, desktop), the Crew VPN VPN service and this website. They are also the end-user licence agreement (EULA) for the apps. By creating an account or using the apps you accept them. If you do not agree, do not use Crew VPN. They are effective from .

How we handle personal data is explained in the Privacy Policy.

The service

Crew VPN is a virtual private network (VPN). The app creates an encrypted connection from your device to one of our VPN servers, and your internet traffic leaves from that server. We work to keep the service available, but we do not promise it will be uninterrupted, available in every country or able to work on every network, and we may change, add or remove server locations and features.

A VPN does not make you anonymous and does not protect you from malware, phishing or websites you sign in to. Do not rely on Crew VPN where a failure of the connection could put you or others at risk.

Your account

  • You must be at least 16 years old, or the minimum age for consent to online services in your country if higher.
  • You can create an account with Sign in with Google, Sign in with Apple, or with an email address and password. Give accurate information and keep your sign-in secure. You are responsible for what happens under your account.
  • You can delete your account at any time in the app (Settings → Delete account) or on the account deletion page.

Licence to use the apps

We give you a personal, non-exclusive, non-transferable, revocable licence to install and use the apps on devices you own or control, for your own use, under these terms and the rules of the store you got the app from. You may not sell, rent or sublicense the apps, or copy, modify or reverse-engineer them except where the law or a third-party licence allows it. The apps include third-party components under their own licences (including the MIT and Apache-2.0 licences, and the SIL Open Font License 1.1 for the Inter font); those licences apply to those components.

Free use

  • Without a paid plan you can use free sessions of 10 minutes: one free session per person per day. A free session starts when you tap Connect and the ad described below has been shown, runs on one device and needs no payment details.
  • The allowance resets at midnight in our server’s time zone. Unused minutes do not carry over, and a session always ends after 10 minutes. The app shows when the next free session is available.
  • Free use is one per person per day. Another account with an email address or Google/Apple account that has already used today’s free session (including a deleted account) does not get another one. See the Privacy Policy for how we check this.
  • When a free session ends, the VPN disconnects. Nothing is charged and nothing renews automatically: to keep using Crew VPN without a time limit you buy a plan.
  • We may set a different allowance for an individual account (for example as a goodwill gesture), and we may change the length of free sessions, how often they are available, whether you can watch an ad for more free minutes, or end free use for new sessions at any time.

Ads

  • For people without a paid plan, the Android and iPhone/iPad apps show a short ad before each free session. You choose to watch it by tapping the button that offers free minutes; the free session starts when the ad has been shown. If no ad can be loaded, the app may show our own message instead or ask you to try again.
  • Without a paid plan the apps may also show messages about our own plans. The apps do not show ads on top of the system VPN dialogs or in notifications.
  • Paid plans (passes and subscriptions) have no ads.
  • Ads are provided by Google AdMob. Ads from other companies are their responsibility, not ours, and buying from an advertiser is between you and the advertiser. How ad data is handled is explained in the Privacy Policy.
  • You must not get around the ads or the free-use limits, for example by faking ad views or creating extra accounts.

Plans, subscriptions and payment

  • You buy plans in the app: with Google Play on Android and the App Store on iPhone and iPad. Payment is taken by Google or Apple from your store account, under the store’s terms. We never see your card details. The price, currency and taxes are shown in the store before you confirm; the reference prices on the home page are only a guide.
  • Economy (3 days): a one-time purchase that gives access for 3 days and does not renew.
  • Business (monthly) and First Class (yearly) subscriptions renew automatically. Your store account is charged at the start of each new period, at the then-current price, unless you cancel at least 24 hours before the current period ends. Your store tells you in advance about price increases where required.
  • Cancel any time in your store account: in Google Play (Profile → Payments & subscriptions → Subscriptions; how to cancel on Google Play) or in your Apple ID settings (Settings → your name → Subscriptions; how to cancel with Apple). After cancelling, you keep access until the end of the period you paid for. Deleting the app or your Crew VPN account does not cancel a subscription.
  • Each plan covers 1 or 2 devices at a time, as shown when you buy. If you connect more devices than your plan allows, the oldest device may be signed out of the VPN.
  • Restore purchases in the app links a purchase to your account again, for example on a new phone. A purchase can belong to only one Crew VPN account.

Refunds

Because Google and Apple take the payment, refunds are handled by them under their policies: Google Play refunds, App Store refunds. We cannot issue refunds ourselves. When a store tells us that a purchase was refunded, access from that purchase ends. This does not limit any rights you have under consumer law.

Acceptable use

You must not use Crew VPN to:

  • break the law, or help anyone else do so;
  • send spam, run phishing or fraud, distribute malware, or attack, scan or disrupt other networks or systems (for example denial-of-service attacks or brute-force attempts);
  • infringe copyright or other intellectual-property rights, or share material that exploits children;
  • harass, threaten or harm others;
  • overload or interfere with our servers, resell access, share your account with people outside the device limit of your plan, or try to get around the free-use limit, the ads, the device limit or payment;
  • probe or attack the Crew VPN service itself (report vulnerabilities instead).

You are responsible for using a VPN in line with the laws of the country you are in and the rules of the networks and services you use.

Suspension and termination

We may suspend or close an account that breaks these terms, puts the service or others at risk, or where the law requires it. Where reasonable we will tell you first. If we close your account for a reason that is not your fault, or stop the service, cancel your subscription in your store account and contact us; refunds are handled as described in Refunds. You may stop using Crew VPN and delete your account at any time.

Disclaimer

To the extent the law allows, the apps and the service are provided “as is” and “as available”, without warranties of any kind, including fitness for a particular purpose and uninterrupted or error-free operation.

Limitation of liability

To the extent the law allows, Crew VPN is not liable for indirect, incidental, special or consequential losses, or for loss of data, profits or business, arising from your use of the apps or the service. Our total liability for any claim is limited to the amount you paid for Crew VPN in the 12 months before the claim. Nothing in these terms limits liability that cannot be limited by law, such as for death or personal injury caused by negligence, or for fraud, or your statutory rights as a consumer.

App Store and Google Play

If you got the app from the Apple App Store, the following also applies. These terms are between you and Crew VPN only, not Apple, and Crew VPN, not Apple, is solely responsible for the app and its content. Your licence is limited to using the app on Apple-branded products you own or control, as permitted by the Usage Rules in the Apple Media Services Terms. Apple has no obligation to provide maintenance or support for the app. If the app fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any) for the app; to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app. Crew VPN, not Apple, is responsible for addressing any claims relating to the app, including product liability claims, claims that the app fails to conform to legal or regulatory requirements, consumer-protection and privacy claims, and any third-party claim that the app infringes intellectual-property rights. You confirm that you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and that you are not on any U.S. Government list of prohibited or restricted parties. You must comply with applicable third-party terms when using the app. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. Where these terms do not cover something, Apple’s Licensed Application End User License Agreement applies.

If you got the app from Google Play, the Google Play Terms of Service also apply to your purchase.

Changes to these terms

We may update these terms, for example when we add features or the law changes. We change the date at the top, and for material changes we tell you in the app or by email before they apply. If you do not agree, stop using Crew VPN and cancel your subscription; continuing to use it means you accept the new terms.

Governing law

These terms are governed by the laws of India, and disputes are handled by the courts of India. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live, and you may bring claims in its courts.
